The NSW Resources Regulator has accepted an enforceable undertaking from Rangott Mineral Exploration Pty Ltd (Rangott) and Catalina Resources Ltd (Catalina) in relation to nine alleged contraventions of the Mining Act 1992.
On 21 July 2022, The Regulator supported the commencement of prosecution against Catalina for nine breaches of s.378D of the Mining Act – (Contravention of condition of authorisation and Rangott for nine breaches of S.378EA of the Mining Act – (aiding and abetting the commission of an offence) while Rangott undertook activities on EL9155 held by Catalina Resources Limited (then known as Shree Minerals Limited).
The Regulator has accepted an enforceable undertaking from Rangott that includes:
- The reimbursement of $12,000 for investigation and administration costs and $3,000 for compliance monitoring costs to the NSW Resources Regulator within 30 days of this enforceable undertaking taking effect
- The review of operations to be completed within 6 months of the enforceable undertaking taking effect
- Carrying out compliance training on the applicable requirements of the Mining Act, within 6 months of the enforceable undertaking taking effect
- Engaging a suitably experienced speaker to carry out research and deliver results of research to the Association of the Mining and Exploration Companies on best practice for consultants engaged to carry out work on behalf of tenement holders within 9 months of this enforceable undertaking taking effect
- Making a donation of $52,500 to Upper Snowy Landcare Network for the purpose of protection and management of local threatened ecological communities within 30 days of accepting this enforceable undertaking.
The Regulator has accepted an enforceable undertaking from Catalina that includes:
- Donating $67,500 to the Monaro District of the NSW Rural Fire Service (MRFS) to be used for the purchase of training aids within 30 days of receiving invoice or payment instructions from MRFS
- Engaging Umwelt (Australia) Pty Ltd to author an article focussing on ‘best practice requirements for ensuring aboriginal ecological requirements are met’ and providing a copy of the article to the NSW Resources Regulator for approval prior to publishing in the Digging & Drilling magazine, at a minimum cost of $6,964.00 within 12 months of accepting the undertaking
- Donating $52,500 to Upper Snowy Landcare Network (USLN) to undertake projects to assist in improving local vegetation and protecting the natural environment in the region of the Central Monaro within 30 days of accepting the undertaking.
- Reimbursing $12,000 for investigation and administration costs and $3,000 for compliance monitoring costs to the NSW Resources Regulator within 30 days of this enforceable undertaking taking effect
- Catalina must spend a minimum of $141,964 (excluding GST) in complying with all strategies and conditions within the enforceable undertaking.
